These Terms and Conditions (“Terms”) govern your access to and use of the GAIA mobile application (the “App”). By downloading, accessing, or using GAIA, you agree to be bound by these Terms. If you do not agree, you must not use the App.

1. About GAIA

GAIA is a wellness and self-tracking application designed to help users record, organise, and reflect on health and wellbeing information, including notes, audio recordings, images, and AI-generated summaries.

GAIA does not provide medical advice, diagnosis, or treatment.

2. Eligibility

You must be at least 16 years old to create an account and use GAIA.

Parents or legal guardians may create and manage profiles for their children of any age within their own account. Children may not independently create accounts or use the App.

By using GAIA, you confirm that you meet these eligibility requirements.

3. Account Registration and Security

You are responsible for: - Maintaining the confidentiality of your account credentials - All activity that occurs under your account

You must notify us promptly if you believe your account has been compromised.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Use of the App

You agree to use GAIA only for lawful purposes and in accordance with these Terms.

You must not: - Use the App to provide medical or clinical advice to others - Upload content that is unlawful, harmful, or infringes the rights of others - Attempt to interfere with the App’s operation, security, or integrity - Reverse engineer or misuse AI features beyond their intended purpose

5. Health Disclaimer

GAIA is provided for wellness and informational purposes only.

The App and any AI-generated summaries or insights: - Are not medical advice - Are not intended to diagnose, treat, cure, or prevent any disease - Should not replace consultation with qualified healthcare professionals

You use GAIA at your own discretion and risk.

6. AI Features

GAIA uses artificial intelligence to generate summaries and organisational insights based on content you choose to record.

• AI outputs are generated automatically and may be incomplete or inaccurate

• You remain responsible for how you interpret and use AI-generated content

• GAIA does not make automated decisions with legal or similarly significant effects on you

Your personal data is not used to train public or general-purpose AI models.

7. User Content

You retain ownership of the content you create or upload to GAIA, including text, audio recordings, images, and notes (“User Content”).

By using the App, you grant GAIA a limited, non-exclusive licence to process your User Content solely to provide and improve the App’s features.

You are responsible for ensuring that you have the right to upload any content you submit.

8. Sharing and Connections

GAIA allows you to connect with other users you invite and to share selected content with them.

• Sharing is optional and controlled by you

• Shared content is private and visible only to approved connections

• You are responsible for deciding what content you share

GAIA is not responsible for how other users use content you choose to share with them.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal data are governed by our Privacy Policy, which forms part of these Terms.

10. Account Closure and Termination

You may close your account at any time.

Upon account closure: - Identifiable personal data will be deleted or anonymised in accordance with our Privacy Policy - Anonymised data may be retained unless you request full deletion

We may suspend or terminate your access to GAIA if you breach these Terms or if required by law.

11. Availability and Changes

We aim to make GAIA available at all times but do not guarantee uninterrupted access.

We may modify, suspend, or discontinue any part of the App at any time.

12. Intellectual Property

All intellectual property rights in GAIA, including software, design, branding, and AI systems, belong to us or our licensors.

You may not copy, modify, or distribute any part of the App except as permitted by law.

13. Limitation of Liability

To the fullest extent permitted by law: - GAIA is provided on an “as is” and “as available” basis - We are not liable for any loss or damage arising from your use of the App, including reliance on AI-generated content

Nothing in these Terms limits liability that cannot be excluded by law.

14. Governing Law

These Terms are governed by the laws of England and Wales, unless local law requires otherwise.

15. Changes to These Terms

We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
